KILKENNY, District Judge.

This is a condemnation proceeding. 'The cause is before the Court on the .motion of the defendants Rands, for permission to file an answer setting up a defense challenging the right of the United States to condemn defendants’ property.

The record discloses that defendants were served with complaint in this cause on August 13, 1963. A declaration of taking 1 was filed herein on August 13, 1963.
