This action of contract or tort arises out of an alleged breach of a covenant in a lease. The property involved in the lease consisted of a store and its equipment. The judge found for the plaintiff. A report to the Appellate Division was dismissed and the defendant appealed.

At the trial the defendant presented twenty-one requests for rulings, but these need not concern us, as all of them were granted.
