This suit was filed in the court below by appellee Boyer, a resident of Grayson county, Tex., against one T. W. McGraw and appellant, E. Duvall, as defendants, appellant being a resident of Knox county, and appellee and McGraw being residents of Grayson county, to recover the sum of $2 per acre, alleged by appellee to have been contracted to be paid by appellant to said McGraw for the execution of certain oil leases by McGraw to appellant, leasing to said appellant, 1,185 acres of land at $2 per acre.
