In tbe Common Pleas Court this was a civil action tried to a jury, and tbe record discloses that a judgment after the overruling of the motion for a new trial was entered in .that court on the 6th day of January, 1936, which was after the time the new Appellate Procedure Act took effect.
On the 11th day of January, 1936, a petition in error, so called, was filed in this court, to which was appended a waiver of service of summons, signed by the attorneys for the defendant in error, all of which was in due accord with the old law governing error proceedings, which, however, had been repealed as…
