ROBERT M. PARKER, Circuit Judge:

Appellant Joe Washington (‘Washington”) appeals the summary judgment dismissal of his state law negligence action against the Resolution Trust Corporation (“RTC”). Washington argues that the district court misapplied Texas negligence law to the summary judgment evidence and abused its discretion in not allowing him to supplement the record after judgment. Because we find that the district court erred in its analysis of Texas negligence law, and because Washington did not have adequate notice of that portion of the summary judgment entered sua sponte, we reverse…
