The defendants, John C. Snyder and Charles R. Bur-key, were indicted, tried, and convicted of fraudulently making and signing, and being concerned in fraudulently making and signing, a written instrument, and of fraudulently uttering and publishing the same. The indictment was drawn under section 169 of the Act of March 31, 1860, P. L. 382 (18 PS §3631), which provides: “If any person shall fraudulently make, sign, alter, utter or publish, or be concerned in the fraudulently making, signing, altering, uttering or publishing any written instrument, other than notes, bills,…
