Error to a judgment of tire Circuit Court of Eauquier county,, rendered September 12, 1896, in an action of assumpsit wherein, the defendant in error was the plaintiff, and the plaintiff in error was the defendant.

This is-the sequel of the case of Goode & Co. v. Georgia Home Ins. Co., reported in 92 Va. 392, and comes before us upon a writ of error to the judgment of the Circuit Court rendered upon a demurrer to the evidence.

The policy of insurance was issued to W. B. Goode &s Co.,, and the suit was instituted in the name of W. B. Goode and A, M. Wright, partners, trading under the firm name of W. R*753Goode & Co. The objection was made that A. M. Wright was not proved to be a partner at the time the policy was issued, and that there was consequently a variance between the allegations and the proof.…
