MURRAY, Justice.
This is a workman’s compensation case in which the appellee, Jack Tubbe, recovered a judgment in the trial court against the appellant, Federal Underwriters Exchange, for total and permanent disability. This is the second appeal of this case, the first having resulted in an affirm- anee of a judgment for total and permanent disability by the Amarillo Court of Civil Appeals, 180 S.W.2d 473, and a subsequent reversal by the Supreme Court, 183 S.W.2d 444.
