COLLINGS, Justice.

This is a workmen’s compensation suit. Henry Vaughn sought to recover compen- satión from Traders & General Insurance Company for-an alleged accidental injury' to his back sustained on April 11, 1956, while in the employ of Foree Drilling Company. The case was tried before a jury which found that Vaughn did suffer the alleged injury and as a result sustained total incapacity to work for a period of 35 weeks and thereafter suffered or will suffer á 40 percent partial incapacity for a period. of 156 weeks.
