In 2003 the City of Cranston (city) was faced with a fiscal crisis. In the midst of this period of financial distress, Mayor Stephen P. Laffey terminated the employment of each of the city’s existing crossing guards in an effort to manage more effectively the city’s budget.1 After losing their jobs, the crossing guards, through their union, Rhode Island Laborers’ District Council, on behalf of Public Service Employees’ Local Union 1033 (Local 1033), filed a grievance, alleging that this termination violated the parties’ collective-bargaining…
