URBINA, District Judge.

Granting the Defendants’ Motion to Dismiss

I. INTRODUCTION

This matter comes before the court on the defendants’ motion to dismiss pursuant to Federal Rules of Civil Procedure 12(b)(1) and (6). The defendants alternatively move for summary judgment pursuant to Federal Rule of Civil Procedure 56. Evelyn L. Lewis (“the plaintiff’ or “Commander Lewis”), brings this suit for damages under the Administrative Procedure Act (“APA”), 5 U.S.C. § 701 et seq.
