This matter is before the Court on the parties’ cross motions for summary judgment (Doc. Nos. 10 and 14) and on Plaintiffs Motion for Class Certification (Doc. No. 4).

BACKGROUND

Plaintiff brings this action pursuant to 42 U.S.C. § 1983, on behalf of herself and a class of others similarly situated, to challenge the constitutionality of the “innocent owner” provisions of Ohio R.C. § 4511.195.
