Appeal from a judgment of the County Court of Greene County (Lalor, J.), rendered June 10, 1997, convicting defendant upon his plea of guilty of the crime of criminal possession of a controlled substance in the third degree.

*783On July 24, 1996, defendant was indicted for criminal possession of a controlled substance in the third degree (two counts) stemming from two sales of cocaine on September 13, 1995, in the Village of Catskill, Greene County. The monitored sales were made to the same undercover police officer from the State Police. Defendant was arraigned on August 5, 1996.
