Twin brothers, Philip and Paul Malone, began their service as Boston firefighters in 1978.3 It was not *148until 1988 that the commissioner of the Boston fire department (the department) informed the personnel administrator (the administrator) that he had reason to believe that the brothers had falsely claimed minority status on their applications for appointment to the department. See note 3, supra.
A hearing officer appointed by the administrator held a two-day evidentiary hearing and concluded that the Malones did not qualify as “black” under established criteria.4 She also concluded that the…
