This is an appeal by the city of Gloucester from a grant of summary judgment for the defendants. The judgment affirmed an order of the Civil Service Commission (commission) requiring the city to reinstate the defendant D’Antonio to his employment as a junior draftsman in the city’s department of public works (DPW). Because we hold that D’Antonio’s separation from employment was proper, we reverse the summary judgment for the defendants and remand this case to the Superior Court for the entry of an order reversing the commission’s order.
