This matter comes now before the court upon two motions for dismissal pursuant to Fed.R.Civ.P. 12(b)(6), for failure to state a claim upon which relief can be granted, filed by the defendants Richard D. Bogert and Bogert Oil Company (hereinafter collectively referred to as “Bogert”), and by the defendants Buck Drilling and Exploration Company, Buck Exploration, C. Paul Buck and Irene P.
