OPINION OF THE COURT

Respondent, Alan J. Weiner, was admitted to the practice of *68law in the State of New York by the First Judicial Department on January 18, 1982. At all times pertinent to this proceeding, respondent maintained an office for the practice of law within the First Judicial Department.

Respondent was served with a notice and statement of charges dated November 12, 1996 in which it was alleged that he violated Code of Professional Responsibility DR 1-102 (A) (4), (5) and (8), DR 6-101 (A) (3) and DR 9-102 (B) (1) (22 NYCRR 1200.3, 1200.30, 1200.46), by inter alia, intentionally…
