FINDINGS OF FACT AND CONCLUSIONS OF LAW
GEORGE L. PROCTOR, Bankruptcy Judge.
This proceeding came before the Court on a five count complaint regarding a contract dispute. Upon the evidence presented at trial on December 12, 1995 and February 20, 1996, the Court enters the following findings of fact and conclusions of law:
1. Defendant Lathan Construction Corporation (Lathan), a general contractor, entered into a construction contract to build a Lowe’s store in Ocala, Florida (the project).
