This is an action of ejectment by Nisbet Hambaugh against Jim Mc-Graw, Robert Bradford, and Jeff Scott, for the east half of section 28, township 19, range 3 west, in Jefferson county. The defendants are tenants of G. H.‘ Weaver, the landlord. G. H. Weaver appeared and filed plea of general issue, and the tenants filed a similar plea. The jury returned a verdict in favor of the defendants, and, from a judgment thereon by the court, this appeal is prosecuted by the plaintiff. This is the second appeal in this cause. Hambaugh v.
