Two questions were raised by the.assignments of error in this case: first, it is contended that the finding of the trial court that more than fifty per cent, of the stock in the Blair Farmers Exchange was duly subscribed is against the clear preponderance and great weight of the evidence; second, that the court erred in refusing plaintiffs a trial by jury.
