WINTER, District Judge:

Motions to dismiss in the above entitled cases raise the question of whether the surviving dependents and estate of a deceased workman who have received or are entitled to receive workmen’s compensation benefits under the Maryland Workmen’s Compensation Act, Annotated Code of Maryland, Article 101, allege a cause of action when they allege that negligence on the part of the employer’s workmen’s compensation insurer, hereafter more particularly described, constituted a proximate cause of the workman’s death.
