OPINION ADOPTING MAGISTRATE’S REPORT AND RECOMMENDATION
ROBERT HOLMES BELL, District Judge.
On September 19, 1988, U.S. Magistrate Joseph G. Scoville issued a report and recommendation (R & R) in these consolidated cases. The R & R was issued pursuant to this court’s order of reference dated May 31, 1988. 28 U.S.C. section 636(b)(1)(B). Both parties have objected to certain portions of the R & R.
