The appellant brought this action against Peter Morton, as the maker, and James F. McDowell and George D. McDowell, as the endorsers, of the following note:

“$50. Marion, Ind., April 5, 1881.
“ One day after date I promise to pay to the order of James F. McDowell & Son, negotiable and payable at Sweetzer’s bank, Marion, Indiana, fifty dollars and attorney’s fees, value received, without any relief whatever from valuation or appraisement laws, with interest at the rate of eight per cent. *171per annum after date.
