Before the Court is Defendants’ motion for summary judgment. The Court held a hearing on this motion on May 11, 2005. At the hearing, the Court denied without prejudice the motion brought by Defendant Macomb County and Macomb County Sheriff Mark Hackel for the reasons stated on the record.
