It appears that on account of high water, and perhaps other causes, Emigrant creek has changed its course, so that it does not run as it formerly did close to the Original Lithia Springs. After making the application No. 4475 and the making of said permit No. 2685, and on December 22, 1915, said Silver and Bailey, for value, conveyed their rights under said application to the Pompadour Mineral Springs Company, the defendant herein.
