delivered the opinion of the Court.

The plaintiff in error and one Dewey King were jointly indicted for larceny and receiving stolen property. King obtained a severance and later pleaded guilty to an attempt to commit a felony and was sentenced to the county workhouse for eleven months and twenty-nine days. Vance was tried and convicted, the jury fixing his punishment at not more than three years in the penitentiary.
