Appellant was convicted, and sentenced to .suffer death, upon a charge of having murdered- his wife. The contention here is that the evidence fails to show appellant to have been guilty, and especially of murder in the first -degree, and that the trial court erred in the instructions given, and in refusing those asked by appellant.
