MEMORANDUM OF OPINION

Plaintiff John R. De Malherbe brought this suit against the International Union of Elevator Constructors (“IUEC”) the International Union of Elevator Constructors Local No. 8 (“Local 8”), and National Elevator Industry, Inc.
