Leon Kirilenko, plaintiff in error, was tried in the criminal ' court of Cook County on an indictment consisting of two counts, the first charging him with taking immoral, improper and indecent liberties with a female child of the age of nine years, and the second charging him with conduct which tended to make the same girl a delinquent child., After waiving a jury, he was tried before the court, was found guilty as charged in the first count and was sentenced to the penitentiary for a term of one to two years.
