Following a bench trial in the circuit court of Cook County, the defendant, Jimmie Tye, was convicted of the murder of his three-year-old daughter, Jasmin James. The State requested a hearing to determine whether the defendant should be sentenced to death for the offense. The defendant waived a jury for purposes of the sentencing hearing. The trial judge determined that the defendant was eligible for the death penalty and that there were no mitigating circumstances sufficient to preclude imposition of that sentence.
