On the 1st day of April, 1909, the plaintiff entered into a contract of subscription with Howeth & Co., for the purchase of 250 shares of stock in the Oklahoma National Life Insurance Company. The contract is as follows:

“The Oklahoma National Life Insurance Company, Oklahoma City, Oklahoma. Subscription to Capital Stock. No. 687. Whereas, Howeth & Co., of Oklahoma City, Oklahoma, are promoting the organization of a life insurance company, incorporated in pursuance of the laws of the state of Oklahoma, under the name of the Oklahoma National Life Insurance Company,…
