This case involves an appeal from an order denying a motion for Rule 11 sanctions. We reverse and remand.

Plaintiff (Appellee) John Jay Hooker (Mr. Hooker) filed a complaint on December 13, 2001, against Governor Don Sund-quist, individually and in his official capacity, and Lieutenant Governor John Wilder, Speaker Jimmy Naifeh, and Attorney General Paul Summers, in their official capacities.
