Appeal by the plaintiff, Arthur M. Werner, from a judgment of the Supreme Court in favor of the defendant, entered in the 'office of the clerk of the county of New York on the 25th day of March, 1915, upon the decision of the court dismissing the complaint after a trial at the New York Special Term.

Clarke, J.:

The action is to recover two installments of $2,500, each alleged to be due under a written agreement entered into between the plaintiff and the defendant on the 15th day of July, 1912. The complaint alleges that prior to his marriage to the defendant plaintiff had been a police officer of the city of New York for upwards of twelve years; that on the 15th day of July, 1912, plaintiff and defendant entered into the written agreement referred to; that the plaintiff has not re-entered the police department and has made no attempt to do so and has no intention of doing so; that…
