OPINION

BISSETT, Justice.

This is a suit arising out of a public construction contract. The Housing Authority of the City of Victoria, Texas, hereafter “the Housing Authority,” in a petition filed on July 30,1979, sought damages from Transamerica Insurance Company, Bruce Campbell & Son Construction Co., Inc., and others, for alleged construction defects arising out of a contract for the renovation of public housing in the City of Victoria, Texas.
