Appellant, P. Armando Gutierrez, appeals from the judgment of the trial court in eight issues. We affirm in part and reverse and render in part.

The underlying dispute between Gutierrez and appellee, Paul Elizondo, involves a construction project in McAllen, Texas. The project entailed the construction of two commercial buildings on adjoining lots and was to be completed by Gutierrez and his company, Strong Hold Construction Company.
