Claimant, Helen Conwell, is a daughter of Marshall Con-well, deceased, a former flagman employed by the Division of Highways of the State of Illinois. On July 30, 1940, while flagging traffic on U. S. Route 50 about one mile east of Carlyle, Illinois, Conwell was struck by an automobile and instantly killed. At the time of the accident, the employer and employee were operating under the provisions of the Workmen ’s Compensation Act of this State, and notice of the accident and claim for compensation were made within the time provided by the Act.
