The earlier history of this litigation is related in Security Trust & Savings Bank of San Diego v. Walsh, 9 Cir., 91 F.2d 481. The present appeal involves the division of the proceeds of an insurance policy.

Appellee Tadlock was the owner of the fishing vessel Yellowtail. Appellee Security Trust & Savings Bank of San Diego was the holder of a mortgage on the vessel as security for the payment of an instalment note in excess of $9,000, made October 22, 1934.
