Preliminary to any consideration of the assignments of error is the question whether the bill of exceptions and the special finding of facts can be considered as a part of the record. The issues formed by the pleadings were tried by the court, without the intervention of -a jury, in September, 1873, and judgment for the plaintiffs was ordered .at April Term, 1874.
