FACTUAL AND PROCEDURAL BACKGROUND

This is a claim for personal injury asserted against a property owner and a general contractor. Fred Meyer Stores (Fred Meyer) owned a partially vacated strip mall in Poca-tello, Idaho. Fred Meyer contracted with general contractor, Bateman-Hall, Inc. (Bateman-Hall), to build a second building on the site.
