MEMORANDUM OPINION AND ORDER

CARRIGAN, District Judge.

Plaintiffs Heather Del Bosco and her father, Armando Del Bosco, both Colorado residents, commenced this diversity action asserting claims for negligence against the defendant United States Ski Association, a Utah corporation. Defendant has moved for summary judgment arguing that the plaintiffs’ claims are barred by: (1) an exculpatory agreement; (2) the Colorado Ski Safety and Liability Act, Colo.Rev.Stat. §§ 33-44^-101 et seq.; and (3) the Colorado assumption of risk statute, Colo.Rev.Stat. § 13-21-111.7.
