JOHNSON, PRESIDENT :
On the 4th day of June, 1885, John B. Henderson was in the Circuit Court of Upshur county indicted for forgery. On the 17th day of February, 1886, the prisoner demurred to the indictment, which demurrer was overruled; and thereupon the prisoner pleaded not guilty. On the 11th day of January, 1886, the trial of the prisoner before a jury commenced; and on the 23d day of the same month the jury rendered a verdict of “ guilty as charged in the indictment.” Whereupon the prisoner moved the court to set aside the verdict and grant him a new trial on the ground of erroneous…
