These two claims arise from an unfortunate automobile accident which claimed the life of Charles J. Quigley and seriously injured his wife, Joan M. Quigley.

On December 23, 1949, at around 8:00 p.m. the decedent, accompanied by his wife, was driving his car easterly along State Highway Route No. 44, enroute to Pittsfield, Massachusetts, from their home in New Jersey. About a mile and a half west of Amenia, at a location known as Fish Hatchery Hill, the car approached a curve and downgrade.
