— Appeal from an order of the County Court of Rensselaer County (Dwyer, Jr., J.), entered January 18, 1984, which granted defendant’s motion to suppress evidence.* 11 On April 28, 1982, defendant was indicted for the crime of murder in the second degree. The warrant for his arrest was executed in the Town of Nassau, Rensselaer County, by State Police officers in the presence of defendant’s father at approximately 4:40 p.m. that date.
