MEMORANDUM OPINION AND ORDER

WATKINS, District Judge.

Marion D. Dunlap (“Marion”) brings this action against BellSouth Telecommunications, Inc. 1 (“BellSouth”), as Sponsor and Plan Administrator 2 of two employee welfare benefit plans in which Curtis Vergil Jarvis (“Curtis”), deceased, participated. She alleges that BellSouth violated the Employee Retirement Security Act of 1974 (“ERISA”) when it paid spousal benefits to defendant Donna Lynn Epperson 3 (“Donna Lynn”).
