MEMORANDUM OPINION

This case came before the court on Defendants’ motion for summary judgment (doc. 24). The parties fully briefed the issues in connection with the motion. Because trial in this case would be conducted as a non-jury trial, the court suggested to the parties- that acceleration to a trial based on the briefs presented in connection with the motion for summary judgment may be appropriate.
