OPINION OF THE COURT

Kassal, J.

By this proceeding, brought pursuant to CPLR article 78, petitioner seeks relief in the nature of a writ of prohibition barring Ms further prosecution under New York County Indictment No. @994/92, Upon examination of the record, we conclude that petitioner has failed to establish entitlement, either in fact or law, to the extraordinary relief requested and, accordingly, the petition is denied and the proceeding dismissed.
