T. A. Cartee, appellee, filed his hill in the chancery court of Smith county against Elizabeth S. Blacketor, a nonresident, for the purpose of confirming his title to certain lands described in the bill. It was alleged in the bill that the complainant and defendant claimed from a common source of title, to-wit, A. J. Davis, and that on the 27th day of October, 1928, said A. J. Davis conveyed said land to J. W. Kersh, taking a deed of trust for two thousand five hundred dollars thereon, with Homer Currie as trustee.
