These proceedings arise out of an automobile accident involving a motor vehicle owned by Burrell Industries Inc., and a motor vehicle owned by Nancy Phillips and driven by her husband, William Phillips. These proceedings were instituted through a complaint that Burrell filed before a district justice naming Nancy Phillips and William Phillips as defendants.
