[1] This is an action for damages for personal injuries and property damage sustained by plaintiff as a result of a collision between an automobile he was driving and an automobile driven by the defendant. The collision occurred April 9, 1948, in the town of Lentner, in Shelby County. Just prior to the accident both parties had been traveling eastwardly on Highway 36 — the plaintiff trailing defendant's car.
