—In a proceeding pursuant to CPLR article 78 to review a determination of the Board of Zoning Appeals of the Town of Hempstead, dated October 25, 2000, which, after a hearing, denied the petitioner’s application for area variances for two parcels of property, the appeal is from a judgment of the Supreme Court, Nassau *385County (Davis, J.), dated January 22, 2001, as amended May 24, 2001, which granted the petition for a new hearing on the application, annulled the determination, and remitted the matter to the Board of Zoning Appeals of the Town of Hempstead for further proceedings.
